Apple has been sued in the federal court of Oakland, California over its Watch, as per a report by GizChina. The lawsuit reportedly alleges that the Apple Watch has an “undisclosed and unnecessarily dangerous security threat” as it does not have enough room inside to allow for the swelling of the internal battery which can cause the display to crack or shatter and that the company has not taken any steps to address the issue. All the Apple Watches from the very first Apple Watch to the Apple Watch Series 6 have reportedly been embroiled in the lawsuit.
“Apple uniformly failed to disclose that the Watches contained the Defect that would cause them to fail and render them an unreasonable safety hazard resulting in injury to the wearer. This makes the Watches unmerchantable and unfit for the uses Apple advertised, e.g., activity oriented, fitness, athletic use, health, and safety”, said the report.
As per the complaint, filed by multiple people, due to an insufficient room inside the Apple Watch, the swelling that can get created can cause “considerable upward pressure” on the watch face which can allegedly cause “detachment, shattering, and/or cracking of the screen through no fault of the wearer. When this happens, it exposes razor-sharp edges and leads to operational failure and/or injuries resulting from unintended bodily contact with the detached, shattered, or cracked screen.”
The plaintiff’s have demanded a jury trial as well as damages for them and those who are part of the class action lawsuit. They have also reportedly asked for the “disclosure of the imperfect design of the smartwatch.”
